Terms of Service

These Terms of Service ("Terms") govern your use of Telli.sh ("Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service. You may not use the Service if you are under 18 years of age.

1. Accounts

1.1 Account Creation

To use the Service, you must register and provide accurate information. You represent that all registration information is truthful and accurate, and you will maintain its accuracy. You may delete your account at any time via account settings. We may suspend or terminate your account in accordance with Section 7.

1.2 Account Responsibilities

You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. You agree to notify us immediately of any unauthorized use or breach of security. We are not liable for any loss arising from your failure to comply.

2. License and Restrictions

2.1 License

Subject to these Terms, we grant you a non-transferable, non-exclusive, revocable, limited license to access and use the Service for your personal, non-commercial use.

2.2 Restrictions

You shall not: (a) license, sell, rent, lease, transfer, or commercially exploit the Service; (b) modify, reverse engineer, or create derivative works of the Service; (c) use the Service to build a similar or competitive product; (d) copy, reproduce, or distribute any part of the Service except as expressly permitted. All intellectual property rights in the Service remain ours or our licensors'.

3. Acceptable Use

You agree not to use the Service for any illegal purpose or in violation of applicable laws. You shall not: infringe others' intellectual property or privacy rights; upload defamatory, obscene, or harmful content; attempt unauthorized access; or use the Service in a manner that could damage, disable, or overburden it.

4. Indemnification

You agree to indemnify and hold us (and our officers, employees, and agents) harmless from any claim or demand arising from (a) your use of the Service, (b) your violation of these Terms, or (c) your violation of applicable laws. We may assume exclusive defense of any matter for which you must indemnify us, at your expense.

5. Third-Party Services

The Service may integrate with or link to third-party services (e.g., AI providers). We are not responsible for third-party terms, privacy practices, or content. Your use of third-party services is at your own risk.

6. Disclaimers

The Service is provided "as is" and "as available." We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free. Some jurisdictions do not allow warranty exclusions; the above may not apply to you.

7. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for any claim shall not exceed fifty US dollars (US $50). Some jurisdictions do not allow liability limitations; the above may not apply to you.

8. Termination

We may suspend or terminate your access at any time for violation of these Terms or for any reason. Upon termination, your right to use the Service ceases immediately. We have no liability for any termination. Sections 2.2, 3, 4, 6, 7, and 9 survive termination.

9. General

9.1 Changes

We may modify these Terms. Material changes will be posted on the Service. Continued use after changes constitutes acceptance. New users are subject to the then-current Terms.

9.2 Electronic Communications

You consent to receive communications from us electronically. Electronic communications satisfy any legal requirement for written communication.

9.3 Export

You agree not to export or re-export the Service in violation of U.S. or other applicable export laws.

9.4 Entire Agreement

These Terms constitute the entire agreement. Our failure to enforce any right does not waive it. If any provision is invalid, the remainder remains in effect.

9.5 Governing Law

These Terms are governed by the laws of the jurisdiction where the Service provider is established, without regard to conflict of law principles.

9.6 Language

These Terms are provided in English and Korean. In the event of any conflict or discrepancy between the English and Korean versions, the English version shall prevail.

Privacy Policy

1. How We Collect Information

We collect information in the following ways:

  • Actively provided: When you create an account, upload audio, or contact us, you provide information directly.
  • Automatically collected: As you use the Service, we collect usage data, session information, and device identifiers.
  • From third parties: We may receive information from authentication providers (e.g., Google OAuth) if you choose to sign in with them.

2. What We Collect

  • Account information: Email, display name, password (hashed).
  • Audio data: Voice recordings you upload or record through the Service.
  • Usage data: Session logs, feature usage, and performance metrics.
  • Device & system information: IP address, browser type, device type where relevant.

3. How We Use Your Information

We use your information to: provide, maintain, and improve the Service; process audio for transcription, translation, and summarization; communicate with you; respond to support requests; enforce our terms; comply with legal obligations; and develop new features.

4. Cookies and Similar Technologies

We use cookies and similar technologies to authenticate sessions, remember preferences, analyze usage, and support advertising on public pages. Third-party vendors, including Google, may use cookies to serve ads based on your prior visits to this website or other websites. Google's use of advertising cookies enables Google and its partners to serve ads based on visits to our site and other sites on the Internet. You can opt out of personalized advertising by visiting https://www.google.com/settings/ads. You can also manage cookies via your browser settings; disabling them may affect Service functionality.

5. Data Sharing and Third-Party Processors

To provide the Service, we share your audio data with third-party AI providers (e.g., OpenAI, Deepgram, Google) for processing. These providers may be located outside your country. See our Voice Data Consent for international transfer details. We require processors to adhere to confidentiality and security obligations. We do not sell your personal information.

6. International Data Transfers

Your data may be transferred to and processed in the United States and other countries. We use safeguards such as Standard Contractual Clauses (SCCs) or equivalent mechanisms where required by law. See Voice Data Consent for details.

7. Lawful Requests

We may disclose your information in response to lawful requests by governmental or regulatory authorities, including for public safety, law enforcement, or legal obligations. Where permitted, we will attempt to notify you before disclosure.

8. Data Retention

We retain your data while your account is active. Upon account deletion, we delete personal data and audio within a reasonable period, except where retention is required by law.

9. Data Security

We implement technical and organizational measures (e.g., encryption, access controls, authentication) to protect your data. No system is completely secure; we cannot guarantee absolute security.

10. Your Rights

Depending on your jurisdiction, you may have the right to: access, rectify, erase, restrict processing, object, data portability, and withdraw consent. Contact [email protected] to exercise these rights. For EEA/UK residents, GDPR rights may apply. For U.S. state residents, additional consumer rights may apply. We will not discriminate for exercising these rights.

11. Liability for Onward Transfer

When we transfer your data to third-party processors, we remain responsible for ensuring processing is consistent with this Policy, unless we can demonstrate we are not responsible for the event giving rise to any misuse.

12. Children's Privacy

The Service is not intended for children under 18 years of age. We do not knowingly collect personal data from users under 18. If we become aware of such collection, we will delete it. For users in the European Union aged 16-17, additional GDPR protections apply per Article 8(1). See our GDPR Data Subject Rights Addendum for details. See also Terms of Service §1.

13. Changes

We may update this Policy. Material changes will be posted on the Service. Continued use constitutes acceptance.

Voice Data Collection & International Transfer Consent

This consent is required to use Telli.sh's voice features.

1. Purpose of Collection

We collect and process your voice recordings to provide transcription, translation, and summarization services. Without this consent, you cannot use the recording and upload features.

2. International Transfer (Required Disclosure)

Your voice data will be transferred to and processed in countries outside your country of residence, including the United States. Our AI service providers (e.g., OpenAI, Deepgram, Google Cloud) operate data centers and processing facilities in the United States and other jurisdictions.

By agreeing to this consent, you explicitly acknowledge and consent to:

  • The transfer of your voice recordings to the United States and other countries where our providers operate
  • The processing of your voice data by these providers for transcription, translation, and related services
  • That data protection laws in these countries may differ from those in your jurisdiction

3. Safeguards for International Transfer

When transferring data internationally, we employ safeguards such as:

  • Standard Contractual Clauses (SCCs) or equivalent legal mechanisms where required by law (e.g., for EEA/UK transfers)
  • Organizational and technical measures to protect your data
  • Data processing agreements with our providers requiring confidentiality and security

If there is any conflict between this consent and applicable data transfer frameworks (e.g., EU-U.S. Data Privacy Framework, SCCs), such frameworks shall govern to the extent required by law.

4. Data Processors

We use the following types of providers for voice processing:

  • Speech-to-Text (STT): OpenAI Whisper, Deepgram, or similar services
  • Translation: Google Translate, NLLB, or similar services
  • AI Summarization: LLM providers for generating summaries

These providers are bound by data processing agreements and implement appropriate security measures.

5. Liability for Onward Transfer

In the context of onward transfers of your voice data to third-party processors, we remain responsible for ensuring that processing is consistent with this consent and our Privacy Policy, unless we can demonstrate we are not responsible for the event giving rise to any misuse.

6. Data Retention

Processed transcripts and metadata may be retained as part of your notes. Raw audio may be temporarily stored for processing and then deleted. Provider retention policies may vary.

7. Your Rights

You may withdraw this consent at any time by:

  • Deleting your account (which will delete your data)
  • Ceasing use of recording and upload features

Withdrawal does not affect the lawfulness of processing based on consent before withdrawal.

Overseas Data Transfer Consent

Telli.sh ("Service") processes your personal data using third-party services located outside of Korea. By using the Service, you consent to the transfer, storage, and processing of your data in the following locations and by the following parties:

2. Purpose of Transfer

Your data is transferred overseas solely for the purpose of providing the Service, including:

  • Real-time speech recognition and speaker diarization
  • Multilingual translation of transcribed content
  • AI-powered meeting summaries and text refinement
  • Payment processing and subscription management
  • Service reliability monitoring and error tracking
  • Transactional email delivery (verification, password reset, usage alerts)

3. Data Protection Measures

Each third-party provider maintains industry-standard security measures:

  • Encryption: All data is encrypted in transit (TLS 1.2+) and at rest (AES-256)
  • Access Control: Strict access controls and audit logging
  • Compliance: Providers comply with GDPR, SOC 2, and/or ISO 27001 as applicable
  • Data Retention: Audio files are retained for up to 1 year; transcription data follows your account lifecycle
  • Data Deletion: Upon account deletion, all associated data is permanently removed within 30 days

4. Your Rights

You have the right to:

  • Withdraw consent at any time by deleting your account (Settings → Data & Privacy)
  • Request data export in JSON format (Settings → Data & Privacy → Download Your Data)
  • Request data deletion with a 30-day grace period for cancellation

5. Legal Basis

For users in the EU/EEA, transfers are conducted under Standard Contractual Clauses (SCCs) or adequacy decisions where applicable. For users in Korea, this consent fulfills the requirements under the Personal Information Protection Act (PIPA) Article 17 (Provision of Personal Information to Third Parties) and Article 17-2 (Cross-border Transfer).
